Trump files appeal in New York fraud case, but the Feb. 23 judgment stays in place
Donald Trump’s lawyers filed notices of appeal on Feb. 26, 2024, taking the first formal step toward challenging the New York civil fraud judgment entered three days earlier. The filing targets the Feb. 23 judgment that implemented Judge Arthur Engoron’s posttrial ruling and set the monetary award at $464,576,230.62, before interest and other consequences are added. The appeal does not vacate the judgment. It puts the case in motion at the appellate level, but the underlying order remains in force unless a higher court changes it or a separate stay is granted. In New York practice, a notice of appeal starts review; it is not the same thing as relief from the judgment itself. ([nycourts.gov](https://nycourts.gov/ctapps/coacase.htm?utm_source=openai))
That distinction matters here because the judgment is a live money obligation, not a theoretical one. The defendants can argue that the trial court erred on the law, misread the evidence, or went too far with the remedy. But until an appellate court acts, or enforcement is paused through the proper procedure, the Feb. 23 judgment remains the operative court order. The case grew out of Engoron’s finding that Trump, the Trump Organization and other defendants inflated asset values on financial statements used to secure loans, insurance coverage and other benefits. The notice of appeal does not resolve that finding. It simply shifts the fight to the next courtroom, with the judgment still sitting at the center of the case.
