Colorado prosecutor charges CBP officer Nicholas Rice over Durango protest encounter
A Colorado district attorney has filed criminal charges against a U.S. Customs and Border Protection officer over a confrontation during an Oct. 28, 2025 protest outside an Immigration and Customs Enforcement facility in Durango.
Court records show Sixth Judicial District Attorney Sean Murray filed charges on April 22, 2026 against Nicholas Rice. The case includes allegations of third-degree assault and criminal mischief.
The filing follows an investigation into the Durango protest encounter and video from the scene. The charges do not decide the case, and Rice remains presumed innocent unless and until a court proves the allegations.
The case now moves into the normal criminal process, where prosecutors will have to support the charges with evidence and Rice will have the chance to respond in court.
