Justice Department Sues Colorado Over Magazine Limit
The Justice Department filed a federal lawsuit on May 6, 2026, challenging Colorado’s restriction on magazines above the state’s 15-round limit. The complaint targets Colorado and state public-safety officials and asks a judge to declare the law unlawful and bar the state from enforcing it against possession of the magazines at issue.
In the filing, the department argues that the magazines are commonly owned accessories paired with firearms in lawful use and that Colorado’s restriction cannot survive under the Second Amendment as interpreted by the Supreme Court. The case is brought under 34 U.S.C. § 12601, the federal civil-rights statute DOJ used to frame the challenge.
The state law has already been litigated in Colorado court. In Rocky Mountain Gun Owners v. Polis, 2020 CO 66, the Colorado Supreme Court upheld the statute on June 29, 2020 under the Colorado Constitution. That decision did not resolve a federal Second Amendment claim, which is what this new case puts before a federal judge.
Colorado’s statute generally bars the sale, transfer, and possession of magazines above the 15-round threshold, while also containing exceptions and grandfathering provisions discussed in the state-court opinion. Unless a court intervenes, the law remains in effect while the federal case moves forward.
